1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, or have the consent of a parent or legal guardian to use FitFy. By using the Services, you confirm that you meet these requirements.

2. Services Description

FitFy provides digital wellness and walking recommendations, including personalized activity insights, habit tracking, and fitness plans.

FitFy is for informational and motivational purposes only. It does not constitute medical advice. We do not guarantee specific outcomes and encourage consulting health professionals when needed.

3. User Accounts

Some features require account creation. You agree to provide accurate, complete information and to keep your login credentials confidential. You are responsible for all activities under your account.

4. Subscriptions, Billing & In-App Purchases

FitFy offers both free and paid features. Some Services are offered via recurring subscriptions.

By subscribing:

• You authorize recurring billing via your selected payment method.
• Subscriptions automatically renew unless canceled at least 24 hours before the next billing cycle.
• You may cancel anytime. After the trial or billing cycle begins, no refunds are issued unless specified in our Refund Policy.
• If you subscribed via the Apple App Store or Google Play, you must manage and cancel your subscription directly through those platforms. Deleting the app does not cancel your subscription.

5. Use of AI

FitFy uses AI technologies to deliver walking guidance and fitness suggestions. By submitting data, you consent to temporary analysis strictly for service delivery.

We do not store biometric identifiers. Data is securely processed and discarded.

You can opt out by not submitting data.

6. Temporary Storage for Service Validation

We may store your last activity analysis for up to 90 days to:

• Handle customer support
• Improve service quality
• Validate service delivery (e.g., in refund disputes)

Data will never be reused or shared for marketing and may be deleted early upon request.

7. User Conduct

You agree not to:

• Use the Services unlawfully or deceptively
• Disrupt or harm system integrity
• Reverse-engineer or misuse any Services

Violations may lead to account termination.

8. Intellectual Property

All content, branding, and materials are the property of FitFy or its licensors. Unauthorized use is prohibited.

9. User-Generated Content

By submitting content (e.g., feedback, photos), you grant us a non-exclusive license to use it only for delivering services. You retain ownership of your submissions.

10. Privacy

Our Privacy Policy explains how we handle your data. By using FitFy, you consent to the practices described.

11. Disclaimer of Warranties

FitFy is provided "as is" and "as available." We do not guarantee outcomes or uptime. Use is at your own risk.

12. Limitation of Liability

To the extent allowed by law, we are not liable for any indirect or consequential damages.

13. Modifications

We may update these Terms. Your continued use indicates acceptance. The latest version will always be available on our website.

14. In-App Purchases

All in-app purchases via App Store or Google Play are subject to their terms. FitFy is not responsible for platform-specific billing issues.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, USA.

16. Dispute Resolution

Disputes shall be resolved via binding arbitration under AAA rules, unless local law prohibits it.
